Booking conditions
These General Booking Conditions (hereinafter referred to as the “General Conditions”) shall govern the commercial relationship between MONTIMAR SA and the user or client arising from bookings made through the forms provided by MONTIMAR SA on its website www.hotelesport.com
Booking through MONTIMAR SA’s websites implies the express acceptance by the client or user of these conditions, as well as the terms of use established for browsing the pages owned by MONTIMAR SA.
These conditions shall apply without prejudice to any legal regulations applicable in each case.
The General Conditions of Contract govern the distance selling relationship between MONTIMAR SA and the user or client, in accordance with the legal provisions, in particular: Law 7/1998, of April 13, on General Conditions of Contracting; Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users; Organic Law 15/1999, of December 13, on the Protection of Personal Data; Law 7/1996, of January 15, on the Organization of Retail Trade; and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.
MONTIMAR SA reserves the right to make any modifications it deems appropriate to the General Conditions without prior notice. Such modifications may be made through its websites in any manner permitted by law and shall be binding while they remain published on the website until validly replaced by subsequent modifications. Nevertheless, MONTIMAR SA reserves the right, in certain cases, to apply Specific Booking Conditions with precedence over these General Conditions whenever it deems appropriate, announcing them in due time and form.
Pre-booking Information
MONTIMAR SA informs that the booking procedure through its website is detailed in the corresponding section for completing a reservation.
Furthermore, MONTIMAR SA informs that the user may access the terms of use available on the website.
By making a booking with MONTIMAR SA through its website, the user or client expressly declares that they know, understand, and accept these terms of use and the General Conditions. Likewise, the user declares that they are of legal age and have the legal capacity required to access MONTIMAR SA’s websites and enter into contracts through them. The user is responsible for treating confidentially and responsibly the identity and password obtained during client registration, and may not transfer them to any third party.
Once the booking is made, the user will view the booking confirmation on the screen and may print it as proof of the booking.
The booking confirmation and the proof of booking (the user’s printed copy) shall not be valid as an invoice.
OPERATION OF THE BOOKING PROCESS
Booking Offers and Price Information
In compliance with current regulations, and in particular with Law 34/2002 on Information Society Services and Electronic Commerce, MONTIMAR S.A. provides, in the section corresponding to the booking process, information on all available reservations, their features and prices.
Nevertheless, MONTIMAR S.A. reserves the right to withdraw, replace or modify the offers made available to customers through its website by simply changing their content. Accordingly, the products and/or services offered at any given time on the MONTIMAR S.A. website shall be governed by the General Conditions in force at that time. Likewise, the company reserves the right to discontinue, without prior notice and at any time, access to the aforementioned products and/or services.
Price Indication
Each available reservation shall indicate its price and whether VAT or any other applicable taxes are included. The prices displayed on the screen shall be those in force at any given time, except in the event of a typographical error. Should the price differ for this reason, MONTIMAR S.A. shall inform the customer by email before proceeding with the charge of the reservation.
Please be informed that the Balearic Parliament has established a new tax applicable to stays in any tourist accommodation in the Balearic Islands as of July 1, 2016 (Law 2/2016 on the Tax on Tourist Stays in the Balearic Islands).
This tax amounts to between €0.75 and €1.50 per day of stay or fraction thereof, plus 10% VAT.
Availability
The availability of the offers provided by MONTIMAR S.A. through its website may vary depending on customer demand. Although MONTIMAR S.A. periodically updates its database, the reservation requested by the customer may be fully booked at that time. In such case, MONTIMAR S.A. shall send an email informing the customer of the unavailability of the offer.
Payment Methods
For reservations made through its website, MONTIMAR S.A. requires the details of a credit card belonging to the reservation holder in order to guarantee the reservation. Please note that no charge will be made to your credit card at the time of booking. The card is used solely as a guarantee. The establishment reserves the right to verify the validity of the credit card prior to the customer’s arrival.
The invoice corresponding to the reservation shall be settled directly at the establishment, either in cash, by credit card, or by any other method accepted by the establishment.
Once the reservation has been completed, you will receive a “Booking Voucher” by email, which must be printed as proof of the contracted services and reservation. Please keep this voucher until your arrival at the hotel and present it at reception. Failure to present this voucher at check-in may result in the hotel not being responsible for any errors related to the reservation, including the agreed rate, number of guests and/or contracted services.
Reservation Cancellation
If you wish to make any changes to or cancel your reservation, you must do so prior to the check-in date indicated in the original reservation, in accordance with the specific conditions of the applicable rate, offer or season. Otherwise, the corresponding charges shall apply.
If the cancellation is made more than 24 hours in advance, no charges will be applied. If the cancellation is made less than 24 hours in advance, the establishment shall be entitled to charge the credit card provided the amount of one night’s stay in the event of a no-show.
Right of Withdrawal
Pursuant to Article 103 of Law 3/2014 of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users, services or goods made in accordance with the consumer’s specifications or clearly personalized, or which by their nature cannot be returned or may deteriorate or expire rapidly, are exempt from the right of withdrawal.
DATA PROTECTION
In accordance with Organic Law 15/1999 on the Protection of Personal Data, MONTIMAR S.A. informs users of its websites that the personal data collected by the company through the forms available on its pages will be incorporated into a file under the responsibility of MONTIMAR S.A., for the purpose of facilitating, streamlining and fulfilling the commitments established between both parties.
Likewise, MONTIMAR S.A. informs users of the possibility of exercising their rights of access, rectification, cancellation and opposition by submitting a written request to the following address: ANTONI MONTIS S/N, 07108, PORT DE SÓLLER (ILLES BALEARS).
Unless you notify us otherwise, we shall understand that your personal data have not been modified, that you undertake to inform us of any changes thereto, and that we have your consent to respond to any queries you may submit and to send you the requested information.
APPLICABLE LAW AND JURISDICTION
MONTIMAR S.A. reserves the right to bring any civil or criminal actions it deems appropriate in the event of improper use of its website and content or breach of these terms and conditions.
The relationship between the user and the service provider shall be governed by the legislation in force and applicable within Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or to the ordinary courts, in accordance with the applicable rules on jurisdiction and competence.
